Form I-9 Flexibility for Expired List B I.D. Ends

Starting May 1, 2022 productions can no longer accept expired List B Identity Documents, per a new announcement from the Department of Homeland Security.

Now that government identification-issuing agencies have reopened to full pre-pandemic capacity, obtaining a renewed identity document is no longer considered burdensome. The policy of accepting expired ID was enacted in May 2020 when the COVID-19 pandemic complicated ID renewal.

If your production accepted an expired List B Identity Document between May 1, 2020 and April 30, 2022 and the document expired on or after March 1, 2020 and the crew member is still in your employ, you must update each crew member's I-9 by July 31, 2022 with a renewed List B ID, a different unexpired List B ID or an unexpired List A ID.

If production submitted Form I-9 with an expired List B Identity Document between May 1, 2020 and April 30, 2022 and the crew member(s) is no longer employed with the production, no action is required.
